Terms and Conditions

Welcome to WarehouseDad (“Online Store”). These terms and conditions state your legal rights and responsibilities with respect to the use of this site. By accessing and using this site, the user agrees to be bound by Terms and Conditions set out in this legal notice.

You may use the services only if you are eighteen (18) years old and above and can form legally binding contracts under Philippine Law.

 

  1. Definition of Terms 

*Customer - refers to any person who made purchase/s in this site. Also refers to “You”, “Your”, “Buyer”;

*Online Store - refers to www.warehousedad.com from which customers can view or buy products; Also refers to “We”, “Our”, “Us”, “Seller”;

*Product- refers to item/s which is/are available and sold on the site;

*Order - refers to a product/s selected and to be bought by/paid by a Customer;

*Account – refers to the account that a Customer creates by registering a valid username and password.  It will also contain the Customer’s pertinent information for the transaction of their purchases;

*Username- refers to the name a Customer registers at the Online store for his/her Account;

*Password- refers to the valid password that a Customer uses together with his/her Username to access the site;

*Voucher – refers to special vouchers or discount for buyers made available by the Online Store;

*Payment Option - refers to a Customer’s choice of payment to be accessed in the checkout page;

*Terms and Conditions – refers to the terms and conditions stated herein which govern the sales agreement between the Customer and the Seller.

 

  1. Customer Account Information

 * First step to access the online site is to sign up for an account. You are required to provide a unique username and password.   Customers are in charge of keeping their username and password safe.  You are solely responsible in safeguarding and maintaining the confidentiality of your username and password.  You agree not to share and allow others the use of your username and password.

*We highly encourage you to regularly change your password to keep your account safe.

*You are solely responsible for all communication and/or transactions made using your username and password (Account).  Warehouse Dad shall not be held liable for any loss, damage, cost and expenses or liabilities arising as a result of or in connection with the wrongful or fraudulent use of your Username and Password (Account).  If you suspect that your username and password has been used without consent or authorization from you, promptly notify us at  customerservice@warehousedad.com

*Please always provide accurate and complete information in your Account.  You are encouraged to always update your personal information.

  1. Product Information

* Each items that are posted on our online site comes with full specification or description.  We strive to provide as accurately as possible the colors and images of our products.  We cannot guarantee that your computer monitor/mobile screen  display of any color will be accurate;

*The descriptions of the products are subject to updates and changes without prior notice and at our sole discretion.  Always read carefully the descriptions and specifications before checking out and paying for your order;

*We strive to keep all our product pricing, descriptions, specifications and promotions up-to-date. However we do not guarantee that the pricing, descriptions, specifications and promotions will be error-free;

 *WarehouseDad reserves the right to:

  1. Limit the sales of our products or services to any person, geographic location or jurisdiction;
  2. Limit the quantities of any products or services that we offer; and
  3. Discontinue any product at any time without prior notice.

*The prices to be paid upon checkout shall be based on the prevailing Selling Price listed on the site at the time of your order, which may or may not be the same as reflected on the site at any time thereafter due to price changes;

*The warranty of our products shall be indicated on our online store. Unless expressly prohibited by applicable mandatory law, the stated warranties shall exclude and shall be in lieu of all other warranties or remedies, whether expressly stated or implied;

*By placing your orders, you need to provide the payment details and billing address and/or delivery address. Double check your details before you proceed on to payment. Any order that you make shall be deemed accurate, complete, unconditional and irrevocable.  Thus, the Seller  shall have the right but is not obligated to process your order.  Subject to the Seller’s discretion, you may request to revise or cancel and order.  The Seller will strive to accommodate your request/s as long as it is commercially reasonable and lawful.

 

  1. Payment

*Payment shall be required in Philippine Peso (PHP)

*Customers may pay for the Products through any of the payment modes allowed by the Online Store.  Your payments will only be credited and accepted when the Seller accepts the Customer’s Order.   

*Customer agrees that he/she will be subject to the terms and conditions of their chosen payment mode.  Customer will not hold the Seller liable for any failure, disruption or error made by the service provider of their chosen payment mode;

*For the Credit Card payments, it is subject for bank approval before we process the delivery of your orders;

*In the event that the Customer fails to pay pursuant to the terms and conditions of the payment mode chosen or the Customer’s payment is cancelled for any reason, Seller shall have the right to cancel the Order or hold the delivery of the product without prejudice to any other right or remedy.

 

  1. Delivery

*Ordered Products shall be delivered to the Delivery address you input in the order form. The delivery shall be made within the specific areas in the Philippines.  Once stated in the order form, the place of the delivery shall not be changed unless the Customer expressly requests from the Seller thru email and the latter expressly agrees in writing;

*Delivery charges for packing and delivery shall be as stated in the order form; 

*Product Delivery Period is subject to the availability of our product and our 3rd party courier partners.  Delivery period stated are mere estimates thus the Seller shall not be held liable for any delays that may occur whilst the products are in transit due to unforeseen events or Force majeure (Acts of God).

*Seller shall not be held liable for any delay in delivery due to negligence on the Customer’s part.

 

      7. Questions or Complaints

*Should you have any questions or complaints, you may contact the seller through “Contact Us”

*In cases of complaints, You must contact the Seller within 3 days from the delivery of the product and upon discovery.  You must notify the seller regarding any of the following:

  1. The Product that was delivered to you was not what you ordered;
  2. The Product does not live up to the description and specifications listed on the product page you ordered;
  3. The Product delivered is lacking the accessories specified in the listing;
  4. The number of Products delivered is not the same as what was ordered;
  5. Upon checking, testing and discovery without misuse by the Customer – the product has factory defect and/or is malfunctioning.

*The Seller shall strive to reply and act swiftly on your complaints within thirty (30) days.  In the event that more time will be needed, the Seller shall inform the customer in writing and call an extension of thirty (30) days;

 

  1. Returns & Refunds Process

*If you have notified the Seller as provided in the preceding Clause and your complaints are related to any of the circumstances enumerated above, you may be entitled to any of the remedies below:

     A.  Return and Replacement – If the product delivered is wrong or has factory defects, the Seller at its discretion, may replace the product and shall borne the shipping fee that will be incurred. Customer must ensure that the  Product to be returned  (1) will have all its components and accessories complete; (2) is contained in its original manufacturer’s packaging when it was delivered; (3) without any mark or evidence that the Product has been misused or damaged; (4) with its original receipt.

      B.  Refunds – In the event that the Product delivered is wrong, or has factory defects and cannot be replaced anymore within 7 days of its purchase and has no evidence of misuse by the Customer, the Seller shall remedy this with a refund within the period stated in the preceding Clause provided that: Customer must ensure that the Product to be returned  (1) will have all its components and accessories complete; (2) is contained in its original manufacturer’s packaging when it was delivered; (3) without any mark or evidence that the Product has been misused or damaged; (4) with its original receipt.  A refund shall be made thru Bank deposit/transfer where the Customer must provide accurate Bank Details for the said refund to be processed.  While we aim to effect refunds at the soonest possible time, the processing of your refunds will take time as stated in the preceding clause.

 

  1. Feedback

     *Providing comments and suggestions will help us improve our products and services.  Please refrain from the use of language that are illegal, criminal, immoral, inappropriate, hateful, obscene, defamatory, offensive, violent, abusive, political, religious, infringing or disrespectful in nature. 

     *You may not use false email addresses or impersonate any person or entity that my otherwise mislead as to the origin of a comment.

     *We may, but are under no obligation to, monitor, edit or remove any comments or content that we deem as unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene and are objectionable and violates the Online Store’s Terms and Conditions.

 

  1. General Provisions 

* These Terms and conditions shall constitute full and complete agreement between the Customer and the Seller.  This agreement shall supersede any prior agreement, representation or understanding whether written or verbal.

*Any changes, revision, waiver or cancellation of any condition contained in these Terms and Conditions must be made in writing. 

* You agree to indemnify, defend and hold harmless Warehouse Dad, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Use or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

* Should any part of this Term be declared contrary to law or unenforceable, then such part shall be deemed severable from the rest of the Terms and the remaining parts deemed in full force and effect. 

*Should there be any dispute arising from the Customer’s use of this Online Store, Customer hereby agrees to submit the same to mediation.  The mediation shall be facilitated by a mediator jointly chosen by the Seller and Customer.  The Customer shall shoulder the mediation fees and expenses.  Customer agrees to refrain from adversarial legal proceedings (except in the case of an emergency necessitating such action) while the mediation process is ongoing.

*The Customer agrees that in case of legal disputes or any judicial action arising from or in relation to these Terms and Conditions, both the Customer and Seller agree that a complaint shall only be filed in the proper court or quasi-judicial agency located in Marikina City. 

*These Terms and Conditions shall be governed by and interpreted under the Philippine Laws, which shall prevail in the event of any conflict of laws.
